Police deserve blame for Constitutional blunders

The Constitution is a hard taskmaster. To protect everyone from intrusions by the police and other law enforcement personal, the Fourth Amendment to the U.S. Constitution prohibits "unreasonable searches and seizures." The police, wishing to search a person or premises need to have a search warrant, which requires a showing of probable cause to a judge that a crime has been committed or will be committed.

You may not know it yet, but the State of Minnesota is one of the toughest states on drunk driving. In fact, Minnesota and only three other states allow results of urine testing to be used as evidence against people charged with DWI. This is true despite the reality that urine tests are widely known to be inaccurate indicators of whether a driver was drunk behind the wheel.

Minnesota increases penalties for higher BAC DWI drivers

A change in the Minnesota DWI law could expose thousands of drivers to much more severe penalties, should they be stopped with higher blood-alcohol concentration (BAC) beginning in August. The threshold for a gross misdemeanor drunk driving charge has been lowered by the legislature from 0.20 to 0.16 BAC.

Odd DUI case places driver's condition above other factors

When it comes to allegations of drunk driving it may be that the condition of the driver is more important than other aspects of the case, at least in the eyes of some courts. This could be one way to read a case that made headlines this past week. The events didn't happen in Minnesota, but because they happened in a neighboring state they are clearly worth noting.
